1. Registering for Samba Mobile Broadband
As part of the registration process, you will need to choose a username and password which will enable you to use Samba Mobile Broadband. You agree to notify us of any changes to your contact details.
You must be 18 years or over to use Samba Mobile Broadband and access to Samba Mobile Broadband is provided for your use only. You may not re-sell or otherwise grant access to Samba Mobile Broadband to any third party. You must treat your username, password or any other information which forms part of our security procedures as confidential and ensure that you do not disclose this information to any third party.
2. USING SAMBA MOBILE BROADBAND
In order to use Samba Mobile Broadband on laptops and desktops, you will need to install the Samba browser extension, known as the Samba Battery. The Samba Battery is available for Firefox and Google Chrome web browsers. iPad users need to add the Samba App to their home screens. The Samba App is a screen icon which links directly to the Samba Mobile website.
In order to use Samba Mobile Broadband, iPad users must purchase a Samba Micro-SIM. Laptop and desktop users must purchase a Samba Dongle & SIM. Existing dongle users must purchase a Standard SIM. If you are using a Samba Dongle & SIM, you will need to install the Samba Connect software onto your computer before you can use Samba Mobile Broadband. You will be prompted to do this when you insert your dongle for the first time.
If you do not own the computer on which you are using Samba Mobile Broadband, you should ensure you have permission to install any required Samba software or app and any new browser.
Please note that by installing the Samba App, Samba Connect or using the SIM card you will lose your right to cancel your order as set out in paragraph 3(c) below.
Samba Mobile Broadband can only be used within the United Kingdom.
3. PURCHASING YOUR Samba dongle & SIM, micro-sim or standard SIM
As part of the registration process you will be directed to a page to order and pay for a Dongle & SIM, Micro-SIM or Standard SIM (the "Product").
By placing an order for the Product this does not mean we have accepted your order. Our acceptance of your order will take effect when we issue you with a written acceptance of your order or we deliver the Product (whichever is earlier). If we are unable to supply you with the Product for any reason, we will inform you of this and we will either cancel or not process the order and will refund to you the amount you have paid to us for the Product (including the delivery charge) within 30 days of cancellation. Refunds will be credited to your original method of payment.
Delivery will usually take place within 5 days of the date of your order. However, please note that timescales for delivery and delivery charges may vary depending on the availability of the Product and your address. Samba Mobile Broadband can only be used within the United Kingdom and we do not accept orders for delivery outside of the United Kingdom.
Delivery of your order will be completed when we deliver the Product to the address you give us for delivery.
The Product will be your responsibility from the time of delivery.
(c) Cancellation and returns
You have the right to cancel your order at any time up to 7 working days (i.e. Monday to Friday excluding bank holidays) after the day you receive the Product.
If you wish to cancel your order within this period please let us know as soon as possible by email to email@example.com.
If you cancel your order after delivery, you must return the Product (including the box (if any), the SIM card, the Getting Started guide and all packaging) to us at your cost within 14 days of cancellation. When you notify us of your cancellation we will confirm the address to which the Product should be sent and may provide you with a Returns Reference Number which should be quoted when you return the Product. You will need to take reasonable care of the Product until it is returned to us.
If you cancel your order we will refund to you the amount you have paid to us for the Product (including any delivery charge) within 30 days of the cancellation. Refunds will be credited to your original method of payment.
Please note that by installing Samba Connect or using the SIM card you will lose your right to cancel your order as set out above.
We guarantee that on delivery and for a period of 12 months from delivery, the Product shall be free from material defects.
In the event that there is a material defect with the Product within the period set out above, please let us know as soon as possible by email to firstname.lastname@example.org. We may then require you to return the defective Product to us.
If we are satisfied that the Product is defective (other than as a result of the circumstances set out below) we will provide you with a replacement Product free of charge.
This guarantee does not apply to any defect in the Product arising from:
- fair wear and tear;
- wilful damage, abnormal storage, accident or negligence by you or by any third party;
- if you fail to operate or use the Product in accordance with the user instructions; or
- any alteration or repair made to the Product by you or by a third party.
(e) Your rights
In addition to the rights set out above, as a consumer, you have will have legal rights if the Product is faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
4. EARNING data credit
Once you have purchased your Product, Samba Mobile Broadband is provided free of charge provided you have sufficient Data Credit.
Data Credit can be earned by watching advertisements which are displayed on the Samba Ad Page (www.sambamobile.com/ads), which can be accessed by clicking on the Samba battery icon on your browser toolbar or by clicking on the Samba app. Each advertisement viewed will earn you Samba Data Credit. You can keep track of your available credit by placing your mouse over the Samba Battery icon or by checking your MySamba page. We may also contact you using email, text message or a notification message on the Samba Battery to inform you if your Data Credit is running low, but we are not obliged to do so and you remain responsible for ensuring you have sufficient Data Credit.
Data Credit will be lost if your Samba Mobile Broadband account is closed or if the Samba Mobile Broadband service ends. Your Data Credit is personal to you and cannot be transferred or shared with a third party.
Many of our advertisements contain links. To see more information about the product or service shown in the advertisement, simply click on the advertisement and you will be automatically directed to the advertiser's website.
You may earn Data Credit by watching advertisements on the Samba Ad Page while using an internet connection other than Samba Mobile Broadband, such as your home broadband connection. However, you may only use Samba Mobile Broadband on a computer on which you have installed the Samba Battery or Samba App.
Data Credit earned from watching advertisements will not expire.
You may also supplement your Data Credit by purchasing a cash top-up at www.sambamobile.com/cashtopup. Your cash top-up will expire after 30 days and any unused credits will be lost.
5. ACCEPTABLE USE POLICY
You agree not to use Samba Mobile Broadband:
- to do anything illegal including, but not limited to, anything that is in breach of confidence, copyright, privacy or any other rights;
- to cause annoyance, inconvenience or needless anxiety to any person;
- to use any mechanism, device, software, script or routine to affect the proper functioning of any computer system or network, or to take any action that places an unreasonable burden or excessive load on any computer system or network, or to infect any computer system or network with any computer programming routine (e.g. any virus, worm, time bomb, cancelbot or trojan horse) that may damage, interfere with, delay, intercept or expropriate any system, data or personal information, or to game the system by watching more than one advertisement simultaneously or by using a programme or script to play the advertisements; or
- in any way which could interfere with the provision of Samba Mobile Broadband to any other customer, for example if you download, send or upload excessive amounts of data or game the system such that Samba’s ability to provide our service to other customers is jeopardised. We will contact you if your use is excessive or if we suspect you are gaming the system.
6. Third party websites
We do not guarantee that products or services or any websites accessible via Samba Mobile Broadband are error or virus free, and any dealings that you may have with advertisers, promotions, services or merchants via Samba Mobile Broadband are solely between you and the third party with whom you are dealing.
We may terminate the provision of Samba Mobile Broadband and close your Samba Mobile Broadband account:
- by giving you not less than four weeks' advance notice of termination by email or otherwise in writing;
- immediately by giving you notice by email or otherwise in writing, if you are in breach of these terms; or
- by posting a notice on our website, if we withdraw the Samba Mobile Broadband service generally.
8. privacy and Data protection
You accept that you are using the internet at your own risk. You are responsible for making sure any equipment you use to access Samba Mobile Broadband is protected against viruses and other malware.
Samba Mobile Broadband is provided using the 3 data network over which we have no control. We do not warrant or guarantee the performance of the internet or that the transmission of information over the internet will be secure or that the internet will be accessible at all times or at the speeds indicated by us.
Other than as set out below, our only liability to you will be for damage caused to your property by our negligence. Our liability in these circumstances will be limited to £500 for one claim or a series of related claims. We have no other liability to you for anything we do or don't do, including liability for any loss of income, loss of business, loss of profits, or loss or corruption of data resulting from your use of Samba Mobile Broadband (including your use of the Product).
Nothing in the agreement will remove or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded or limited under applicable law.
10. intellectual property
All intellectual property rights in the content, design, text, graphics and other material forming Samba Mobile Broadband and our other products and services are owned by us and/or our respective licensors.
You agree that any content, software or other copyright material we supply to you is for your own private use, and that you must not copy, change or publish the material or supply it to any other person.
12. CONTACTING US
If you are unhappy with the level of service which you have received from us please see our Customer Complaints Code which sets out our internal complaints procedure and what further steps are available if you believe your complaint has not been dealt with satisfactorily.

If at any time we need to contact you we will do so using the contact details that you provide. We will normally contact you by email. It is your responsibility to provide us with accurate and up-to-date contact information.
